Terms of Service

These Terms govern access to and use of Pixa. By using Pixa for an organization, you represent that you have authority to accept these Terms for that organization. Pixa is intended for business use.

Accounts and workspaces

You are responsible for your account, your authorized users, and activity in your workspaces. Workspace administrators may manage users, permissions, projects, and content. You must promptly notify us of suspected unauthorized access.

The service

Pixa provides a workspace for creating and managing images, video, audio, and other creative work. You may use the service under these Terms and any applicable order or plan. We may update the service over time. Plan features, usage limits, support, and service commitments are governed by the applicable order or published plan description.

Your content

You retain ownership of briefs, images, video, audio, files, data, and other content you submit. You give Pixa a non-exclusive license to host, copy, process, transmit, and display that content only as needed to provide, secure, and support the service.

You are responsible for your content and how you use or share it, including its legality and the privacy and other rights of people it depicts. You must have the rights and permissions needed for Pixa to process your content.

Acceptable use

You and your users must not:

  • violate applicable law or another person’s intellectual property, privacy, or other rights;
  • host or distribute content involving child exploitation, human trafficking, credible threats, or serious harm;
  • operate phishing, fraud, spam, malware, botnets, credential theft, or attacks;
  • access, probe, scan, or test accounts, systems, or data without authorization;
  • disrupt or degrade Pixa or third-party systems, or bypass security, rate limits, quotas, or other technical restrictions; or
  • misrepresent identity, authority, or affiliation.

Pixa may investigate suspected abuse and remove or disable content or projects, limit resources, or suspend access when reasonably necessary. You agree to cooperate in remedying abuse associated with your account.

Third-party services and fees

Pixa may depend on or connect to third-party services. Their terms govern your use of them, and Pixa is not responsible for services it does not control. If you purchase a paid plan, you agree to pay the fees and taxes stated in the applicable order. Except as stated in an order or required by law, fees are non-refundable.

Pixa property and privacy

Pixa and its licensors retain all rights in the service, including its software, design, documentation, and branding. Our Privacy Policy explains how we handle personal information.

Suspension and termination

We may suspend access when reasonably necessary to address a security risk, prevent harm, comply with law, address overdue fees, or respond to a material breach. Where practicable, we will provide notice and an opportunity to resolve the issue. When access ends, your right to use Pixa ends; provisions that by their nature should survive will remain effective.

Disclaimers and liability

To the maximum extent permitted by law, Pixa is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that Pixa will be uninterrupted or error-free.

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Each party’s total liability relating to Pixa will not exceed the fees paid or payable for the service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.

General

These Terms and any applicable order are the entire agreement about Pixa. If a provision is unenforceable, the remaining provisions remain effective. We may update these Terms prospectively and will provide reasonable notice of material changes. Questions may be sent to support@pixa.com.
